Terms & conditions

These Terms and Conditions (“T&C”) apply to the Eranyacloud (PT. Era Awan Digital) site with the web address https://console.eranyacloud.id and its subsidiaries and affiliates (together “Eranyacloud).BY USING Eranyacloud SERVICES (“Service”), YOU (“CUSTOMER”) HAVE AGREED TO THE TERMS AND CONDITIONS BELOW.

Eranyacloud reserves the right at its sole discretion, to change, modify, add or delete these T&C, at any time. Customers are responsible for accessing these T&C periodically to determine whether there have been any changes to the T&C. If the Customer continues to use Eranyacloud services, it means that the Customer accepts and agrees to the changes.

1. Definition

  1. Eranyacloud Service is a cloud computing service owned by PT Era Awan Digital (“Service”);
  2. Authorized Users are Customers and/or employees of customers who have the authority to access Eranyacloud Services;
  3. Customer Data is data provided in the form of non-physical data stored on the Eranyacloud server;
  4. Customer Balance is a value that shows the return of service fees that have been paid in advance by Prepaid Customers when the customer deletes the service before the service period ends (service fee refunds will be calculated on a pro rata basis) and/or service fees received back by the Customer as a form of compensation for restitution services as stated in these T&C. Customer Balance can only be used to reduce the costs that Customers must pay in purchasing new Services and/or Replacement Services and/or extending the validity period of Services. Customer Balance cannot be cashed and/or withdrawn by Prepaid Customers.

2. Legal Provisions

Below are the T&Cs for the services that Eranyacloud will provide to customers:

  1. Eranyacloud only provides the infrastructure needed to implement cloud computing technology used by Customers, so Eranyacloud is not responsible for the applications, content and software used by Customers.
  2. Eranyacloud provides infrastructure including processing systems (CPU & Memory), data storage (Storage), Network and Licenses;
  3. If necessary, Eranyacloud can provide technical support to Customers.
  4. Eranyacloud, according to Company policy, has the right to change service implementation procedures without notification and does not assume any responsibility to customers.
  5. Referring to service standards, for each Eranyacloud service there is a quota for the services provided such as Public IP and the availability of other features. If the Customer wishes to purchase Services outside the limits specified in each Product Catalog, the Customer can submit a written request via the Eranyacloud support portal.
  6. The customer hereby declares that he agrees and agrees with all special service provisions listed in the Product Catalog.
  7. The Service will be activated/reactivated by Eranyacloud after payment related to the use of the Service by the Customer (for Prepaid Services) and after approval by Eranyacloud (for Postpaid Services)

3. Fees & Taxes

  1. Fees include administration fees, stamp duty which must be paid by the Customer. All payments are subject to Value Added Tax (VAT) in accordance with applicable regulations in the Republic of Indonesia and will be borne by the Customer.
  2. Any and all other tax obligations arising in connection with these T&C and their implementation will be the burden and responsibility of each PARTY in accordance with the tax provisions applicable in Indonesia.
  3. Any and all payment obligationsonline and the burden incurred by the payment method will be the responsibility of Eranyacloud.

4. Subscription & Notification Period

  1. Online registration can be done online with https://console.eranyacloud.id/login;
  2. Customers will receive notification via email regarding verification after registering. If within 7 days they do not verify their email, we will consider it canceled and we will delete their account;
  3. Customers will be called by the internal team as verification to ensure that customers are aware and understand the Data Security Policy, Privacy Policy and applicable Terms and Conditions.
  4. Customers will receive notification of completed registration via email
  5. For services currently Post-Paid, the subscription period notification mechanism is as follows:
  • Customer is requested to subscribe autopay by key-in Credit Card and will be charged Rp.15.000
  • Customer will received Invoice on the 1st of the month
  • Credit Card will be charged every month based on Total Amount Due stated in the Invoice by autopay
  • If Customer fails to make payment the following conditions will be applied:
    • Day 3, Payment reminder will be sent to Customer’s email
    • Day 5, Services will be suspended
    • Day 7, Final payment reminder will be sent to Customer’s email
    • Day 9, Services will be Deactivated and Terminated 

5. Service Commitment

  1. Eranyacloud is committed to providing services to customers with an uptime SLA of 99.9% during the service period. The agreed SLA only covers infrastructure services and does not include scheduled maintenance elements.
  2. The maintenance schedule will be notified 7 (seven) calendar days before the maintenance period.
  3. In situations that require maintenance and emergency action, Eranyacloud has the right to inform you no later than 1 x 24 hours.
  4. Customers hereby agree to comply with and follow all instructions in the maintenance information provided by Eranyacloud.

6. Downtime & Retribution Policy

  1.  Eranyacloud guarantees that customers can use the service 24 (twenty four hours) every day, with a minimum service condition of 99.9%, or a maximum downtime of 43.2 minutes every 30 calendar days. SLA (%) = [ Usage hours per month – downtime hours] X 100%
  2. Downtime stated in this service commitment is excluded for:
  • Downtime due to maintenance activities that have been scheduled and communicated to customers.
  • Downtime due to failure to create and/or purchase new Services.
  • Downtime due to actions by customers and/or other third parties caused by customers’ ignorance of using Eranyacloud services.
  • Service interruptions caused by incorrect configuration settings by the Customer are not included in the service credit.
  • Downtime resulting from customers not taking the actions that Eranyacloud recommends.
  • Intermittent downtime that occurs over a short period of time.
  • Downtime on the Cloudiciti Datacomm site or portal that does not impact customer service.
  • Force Majeure that is beyond Eranyacloud’s control. Force Majeure can be (but not limited to) fire, flood, earthquake, war, terrorism, criminal activity, riot, explosion, sabotage, embargo, natural disaster, strike, government policy, change in law or investment policy in Indonesia.
  • Downtime resulting from equipment, software, or other technology owned by customers or third parties outside the equipment that is under the control of Eranyacloud.
  • Other glitches that are not caused by Eranyacloud errors.
  1. If 99.9% availability cannot be met, Eranyacloud will provide service restitution in the form of service credit whose cumulative value increases for every hour of service downtime, until service returns to normal according to the following calculation:

Example of calculating service restitution:
This month there was one VM Server Incident Falling (Down) for 120 minutes in 1 month. So the calculation of service restitution is as follows:

  • Total allowable fall duration: 0.1 % x 30 days x 24 hours x = 0.72 hours/ 43.2 minutes
  • Duration of service interruption: 120 minutes
  • Total Restitution Claim Time: |120 ​​minutes – 43.2 minutes = 76.8 minutes (1 hour 16.8 minutes)
  • The total restitution given to the Second Party is 2 days
  • Restitution in the form of service credit will be (2/30) x 100% = 6.6667% of the related monthly service fee.
  • Post-paid type customers
    The total costs charged in the next month for the previous month’s usage are: (monthly billing costs – refund) So for Postpaid customers, for example, the monthly service fee with a bill of IDR. 3,000,000,-, then after being given the service credit it will be: = Rp. 3,000,000 – (6.6667% X Rp. 3,000,000) = Rp. 2,800,000,-
  1. Claims for refund of this service must be submitted by the Customer to Eranyacloud within a period of no later than 14 (fourteen) Calendar days via the Eranyacloud support portal and approved by Eranyacloud. If restitution is submitted after the specified time period after the disturbance, then restitution cannot be given.
  2. Payment of service refunds as referred to in these T&C is made by:
  • For Postpaid customers, Eranyacloud will provide service credit when calculating bills for the following month.

7. Customer Data Related to Service Implementation

  1. Customers are obliged to provide all data required by Eranyacloud based on written request regarding use of the Service.
  2. Customers are solely responsible for the content and accuracy of such data.
  3. Customer data stored on the Service is owned only by the Customer and Eranyacloud is obliged to protect the confidentiality of this data.
  4. The customer hereby declares that he has provided the data in the registration accurately and precisely. If there is incomplete data during registration, the customer is obliged to complete/update the missing data with correct data as soon as possible.
  5. The customer hereby agrees and agrees to provide any additional data required in the future so that the Eranyacloud service can continue to comply with the latest regulations in force in the Republic of Indonesia.
  6. The customer hereby agrees and agrees to be solely responsible if in the future there is registration data or other data from the customer that is incorrect and/or incomplete which may give rise to legal consequences.
  7. The customer hereby agrees and agrees to receive communications from Eranyacloud via communication channels in accordance with the data provided by the customer.

8. Limitation of Liability

  1. Limitation of Liability (in Agreements, lawsuits, negligence) based on any claim for compensation for any reason in any form is in accordance with the actual value of losses experienced by the Customer with a maximum of 10% (ten percent) of the total subscription value for 1 (one) Year for Prepaid Type Services and a maximum of 10% (percent) of the last month’s bill for Postpaid Type Services.
  2. Eranyacloud is only responsible for the Services as stated in the Subscription Contract and/or in accordance with the Shared Responsibility Model (input link)
  3. All matters relating to the installation of applications and their consequences carried out by Customers on Eranyacloud Services are not the responsibility of Eranyacloud. Eranyacloud is not responsible for damage and/or loss of data that may occur on end user devices when using all kinds of email client software such as Microsoft Outlook or other email client software. The customer is responsible for maintaining the email client software used by each end user.
  4. The Customer hereby understands all the risks of using the Services provided by Eranyacloud, for this reason the Customer is willing to release Eranyacloud from all forms of legal claims including requests for compensation due to these risks along with liability as a service provider in the event of a Force Majeure Event in the implementation of the Service provision. to Customers.
  5. Eranyacloud reserves the right to do the following, at any time, without notice: (1) change, suspend, or terminate access to the service; (2) interrupt operation of the service, or any part of the service, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

9. Service Changes

  1. Enhancement/Upgrade Service
    •  Enhancement/Upgrade services can be carried out independently by the Customer.
    • Customers who purchase Postpaid Type Services can use the upgrade service and the upgrade service bill will be listed on the following month’s bill with a prorated calculation.
  2. Decrease/Downgrade Service
    • Decrease/Downgrade service does not apply to Prepaid Type Services.
    • Customers who purchase Postpaid Type Services can use the downgrade service directly and the bill for the downgrade service will be listed on the following month’s bill with a prorated calculation.

10. Suspension & Termination of Services

  1. Eranyacloud has the right to suspend the Service and/or terminate the Service, if the Customer:
    • Commits violations as regulated in the T&C
    • Violates material provisions of the T&C, the violation of which can be corrected (including failure to pay bills to Eranyacloud), and if the Customer who violates has not corrected the violation within 7 (seven) calendar days from the 3rd notification from Eranyacloud.
    • If the Customer fails to complete payment during the Service suspension period, Eranyacloud has the right to automatically terminate the Customer’s account.
    • By terminating the account in question, the use of Eranyacloud’s Cloud resources used by the Customer will be stopped and the account and data will be permanently deleted. Resources that have been deleted cannot be recovered in any way.
    • Bankruptcy, ceasing to carry on business as a going concern, being unable to pay its debts when they fall due, or being subject to the institution of voluntary or involuntary proceedings in bankruptcy or liquidation.
    • If the Customer, its employees, agents, contractors or related third parties access the services unlawfully, causing any breach of security relating to the Services, or if Eranyacloud reasonably suspects any fraudulent or unlawful activity on the part.
  2. The mechanism for suspension and termination of services is in accordance with the Purchase and Payment Terms.
  3. If the service is suspended, the Customer cannot access the service and is not entitled to receive restitution.
  4. The customer hereby declares that he ignores the provisions of Article 1266 of the Indonesian Criminal Code (Indonesian Civil Code). Upon expiration or termination of these T&Cs for any reason, Customer’s right to use the Services, and any other rights granted to Customer under these T&Cs, immediately terminate. All fees for Services provided to the Customer will be due and payable upon receipt of the invoice and final invoice.
  5. If the Customer decides to stop subscribing to the Eranyacloud service before the period of use of the Service chosen by the Customer, then the Customer cannot get a refund for the service they are currently using.

11. Customer Policy on Use of Services

  1. Customers are responsible for the internet connection that will be used to access Eranyacloud Services.
  2. The customer guarantees that the services provided by Eranyacloud are used according to their intended purpose and do not violate these terms and conditions and applicable laws and regulations.
  3. Customers agree to use the services only for business purposes and in accordance with the technical documents and/or Product Catalog that apply to each Eranyacloud Service at this time and determined by Eranyacloud from time to time.
  4. Customers are fully responsible for all costs and engineering resources required to use the services.
  5. Customers are responsible for maintaining the confidentiality of customer content in data storage locations, and are responsible for any losses that may arise as a result of unauthorized use of customer content. If Customer has reason to believe that the data storage location is no longer secure, Customer agrees to immediately notify Eranyacloud of the same.
  6. Customers are prohibited from using, exporting or re-exporting any content, any copy, adaptation of such content, or any services offered, which violates any applicable law or regulation, especially the applicable legal regulations in the Republic of Indonesia.
  7. Customers are obliged to ensure that all information and/or data provided by Customers to Eranyacloud is information and/or data that is accurate, complete and not misleading.
  8. In using Eranyacloud Services, Customers are required to keep personal backups of software, sites, databases and all Customer content. Customers agree and agree that Eranyacloud is not responsible for the risk of data loss or data corruption, including in the event of an upgrade, downgrade, maintenance of Eranyacloud’s devices and/or devices related to the Service. Customers are advised to use backup services from Eranyacloud and managed services for backup facilities and operational services.
  9. Customer may only use the service to store, retrieve, request, serve and execute Customer Data that is owned, licensed or otherwise lawfully obtained by Customer (“Customer Content”).
  10. Customers are granted permission to use certain software (including related documentation) developed and owned by the Principal or licensors and/or Eranyacloud only for the use of Eranyacloud Services.
  11. If Customer chooses to use Principal Software (Microsoft, RedHat, or other), then Customer agrees to these additional terms and conditions in accordance with the Service Provider Agreement (SPLA) model or Cloud service Provider (CSP) model. This particular software is sold or distributed to Customers and Customers may not transfer it, assign it to Others outside the service without specific permission to do so.
  12. Customer shall not remove, alter, or obstruct any copyright, trademark, or other proprietary rights notices contained in or on the Principal Software.
  13. Customer may not reverse engineer, decompile or disassemble Principal Software, unless permitted by applicable law.
    In accordance with applicable laws and permits, each software Principal is responsible for ensuring any damages, whether direct, indirect or consequential, arising from the service.
  14. Software Principals is not responsible for providing any support with respect to the services. Customers cannot contact Software Principals directly for support.
  15. Specific to Microsoft software, customers are not entitled to use Microsoft Software in any application that controls aircraft or other modes of human mass transportation, nuclear or chemical facilities, life support systems, implanted medical devices, motor vehicles, weapons systems, or other scenarios. other similar matters (collectively, “High Risk Uses”). Microsoft and its suppliers do not make any express or implied warranties for High Risk Use. High Risk Use does not include utilization of Microsoft Software for administrative purposes, to store configuration data, configuration techniques and/or tools, or other non-control applications, the failure of which would not result in death, personal injury, serious physical injury or environmental damage. This application may communicate with the application performing the control but may not be directly or indirectly responsible for the control function.
  16. Customers are prohibited from using, or encouraging, promoting, facilitating or instructing others to use, Eranyacloud’s services and/or sites for any illegal, harmful or offensive use, or to transmit, store, display, distribute or make available any illegal, harmful or offensive content. or offensive.
  17. If Eranyacloud finds Customer Content that violates the law, or abuses the rights of any third party or violates the material provisions of the T&C, Eranyacloud will provide notification to Customers regarding Prohibited Content and has the right to ask Customers to remove the content in question from the Service, suspend or disable access to Prohibited Content accounts.
  18. If the Customer does not delete and/or disable access to prohibited content within 2 (two) calendar days after notification, Eranyacloud has the right to delete or disable access to prohibited content or suspend the Service. Prohibited activities or content include:
    • Use of services that cause damage to Eranyacloud servers or other servers on the Internet. If a customer is suspected of misusing resources, whether caused by malware, CPU hogging, or other reasons and causing disruption to other Eranyacloud customer services, the corresponding customer service will be suspended.
    • All Eranyacloud service accounts are equipped with unlimited bandwidth facilities within reasonable limits. If a customer is indicated to be using bandwidth for illegal things such as botnets, seeding/leeching torrents or other illegal activities that could disrupt Eranyacloud customer activities, then Eranyacloud has the right to reduce bandwidth capacity or suspend the customer’s services.
    • Use of services with material that is considered threatening, and has indications of containing ethnicity, religion, race and inter-group (SARA), or material that is protected by confidentiality and other trade regulations.
    • Use of services that support illegal activities and/or actions that are not in accordance with applicable laws and regulations in the Republic of Indonesia.
    • Use of services through material that is copyrighted by another party and its use is without permission.
    • Use of services that cause damage to Eranyacloud’s good name.
  19. Customers are prohibited from using the services to violate the security or integrity of any network, computer or communications system, software application, or computing network or device (each, a “System”). Prohibited activities include:
    • Unauthorized Access, in this case accessing or using any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to violate any security or authentication measures used by a System.
    • Interception is monitoring data or system traffic without permission.
    • Falsification of Origin (falsification of origin). Pertains to TCP-IP packet headers, email headers, or any part of a message that describes its origin or route. This prohibition does not include the use of aliases or anonymous email senders.
  20. Customers are prohibited from abusing the network. Prohibited activities include:
    • Monitoring and/or crawling on the system which can damage or interfere with monitoring and/or crawling system activities.
    • Denial of Service (DoS) takes the form of burdening the target with continuous communication requests so that the target cannot respond to traffic legitimately or provides a slow response that is ineffective.
    • Intentional interference in the form of disrupting system performance, including any deliberate attempt to overload a system by means of mail bombing, news bombing, broadcast attacks, or by carrying out flooding techniques.
    • Operation of certain network services with open networks such as proxies, bypass network traffic schemes, VPN outside the Eranyacloud network, open mail relay, or open recursive domain name servers.
    • Avoid checking the system manually or electronically to avoid all checking activities placed on a system, such as checking access and storage.
  21. Customer may not distribute, publish, send, or facilitate the sending of unsolicited mass email messages, promotions, advertisements, or other solicitations (such as “spam”), including commercial advertisements and informational announcements. Customer will not alter or obscure mail headers or accept the sender’s identity without the express written permission of the sender. Customer will not collect replies to messages sent from other internet service providers if such messages violate this Policy or that provider’s acceptable use policy.
  22. If the Customer becomes aware of any violation of these T&C, the Customer is obliged to immediately notify Eranyacloud and direct Eranyacloud, as requested, to stop or correct the violation. Any reporting of violations of these T&C is done by email to Eranyacloud.

12. Monitoring Terms Applied by Eranyacloud

  1. Customer will provide information or other materials related to Customer Content as reasonably requested by Eranyacloud to verify Customer complies with all applicable provisions. Therefore, Eranyacloud can monitor the external interfaces (e.g. ports) of Customer Content. Customer will not block or interfere with the monitoring process, but Customer may use encryption or firewall technology to maintain the confidentiality of Customer Content. Customer will work with Eranyacloud to identify the source of any issue that Eranyacloud believes may impact Customer Content or materials to be received by end users and controlled by Customer.
  2. Eranyacloud reserves the right to investigate if there is a violation of these T&C or misuse of Eranyacloud services or sites; or remove, disable access to, or modify any content or resource that violates these T&C or any other agreement it has with Customer for use of the Eranyacloud service or site.
  3. Report activities that in Eranyacloud’s judgment violate any law or regulation to law enforcement officials, regulators, or other appropriate third parties. The reporting in question also includes appropriate disclosure of customer information. Eranyacloud, if necessary and/or in accordance with the orders of the applicable laws and regulations in Indonesia, cooperates with appropriate law enforcement agencies, regulators, or other appropriate third parties to assist in the investigation and prosecution of illegal behavior by providing network and system information related to allegations violation of this Policy.

13. Intellectual Property Rights

  1. Intellectual Property Rights relating to the Eranyacloud System and/or all computer programs, documentation and/or any other materials developed and/or owned by Eranyacloud based on and/or in connection with this Service, will remain in the full control of Eranyacloud.
  2. Nothing in these terms and conditions is interpreted as a transfer or transfer or waiver of IPR owned by the Parties either before, during and/or after the implementation of the Services.

14. Confidentiality

  1. THE PARTIES declare that during the service period, the confidentiality and ownership of technical and business information belonging to one PARTY may be disclosed to the other PARTY. This information is considered highly confidential and the PARTY receiving the information is not permitted, either directly or indirectly, to disclose the information to other third parties without prior written approval from the PARTY who owns the information, unless otherwise specified in the applicable laws and regulations.
  2. The provisions contained in this Article will not apply to any confidential information that:
    • Being in the public domain or becoming public domain is not due to the fault of the recipient PARTY
    • It was already known to the receiving PARTY prior to receipt of the information or
    • As disclosed to the receiving PARTY by a third party because there is no obligation of confidentiality towards the disclosing Party or
    • Required to be disclosed for legal purposes, government regulations or in accordance with court orders.

15. Dispute Resolution, Applicable Law & Jurisdiction

  1. The customer hereby agrees that the law that applies and regulates these T&C and other provisions related to Eranyacloud Services is the law of the Republic of Indonesia.
  2. If there is a dispute that arises as a result of the implementation of this service, the Parties agree to resolve it by deliberation and consensus.
  3. If it cannot be resolved by deliberation, then the Parties agree to choose a permanent and unchanging legal domicile and request a settlement at the South Jakarta Court Registrar’s Office.

Privacy Policy

1. General

The Privacy Policy is Eranyacloud’s commitment to protect any data or personal information of users of the Eranyacloud site (PT Era Awan Digital) with the web address Eranyacloud.id or Eranyacloud.com along with its subsidiaries and affiliates (together called “Eranyacloud”), its derivative sites , including and not also the Eranyacloud device application (hereinafter referred to as the “Site”).

The Privacy Policy (including the terms of use of the Eranyacloud site as stated in the Terms & Conditions and other information contained on the Site) sets out the conditions for obtaining, collecting, processing, analyzing, displaying, sending, opening, storing, changing, deleting and/or all forms of management related to data or information that identifies or can be used to identify Users that Users provide to Eranyacloud and/or that Eranyacloud collects from Users or third parties (hereinafter referred to as “Personal Data”).

By clicking “Register” or a similar statement available on the Eranyacloud registration page, the User hereby declares that each User’s Personal Data is correct and valid data, the User is aware and acknowledges that the User has been informed and understands the provisions of this Privacy Policy and the User give consent to Eranyacloud to obtain, collect, process, analyze, display, send, open, store, change, delete, manage and/or use such data for the purposes as stated in the Privacy Policy.

2. Acquisition & Collection of User Personal Data

Eranyacloud’s acquisition and collection of personal data is limited to information that is relevant in accordance with Eranyacloud’s business activities and other purposes and is carried out based on approval or based on the provisions of laws and regulations. User Data collected is as follows:

  1. Data submitted independently by the User, including but not limited to data submitted by the User;
  2. Data to create or update an account on the site, including username, email address, telephone number, password, address, photo and other information that can identify the User;
  3. Data to contact Eranyacloud, including through customer service;
  4. Data to fill out surveys sent by Eranyacloud or other parties officially appointed to represent Eranyacloud;
  5. Data to interact with other Users through message features, product discussions, reviews, ratings, Resolution Center (as defined in the Terms and Conditions) and other interactive features (either one-way or two-way) contained on the Site;
  6. Data for using the services on the Site, including detailed transaction data, including the type, quantity and/or description of the product or service purchased, payment channel used, number of transactions, date and time of transaction, as well as other transaction details;
  7. Data to fill in payment data when Users carry out payment transaction activities via the Site, including but not limited to bank account data, credit cards, virtual accounts, instant payments, internet banking, retail outlets; and/or use features on the Site that require permission to access relevant data stored on the User’s device.
  8. Data recorded when Users use the Site, including but not limited to:
  9. Real or approximate location data such as IP address, Wi-Fi location and geo-location;
  10. Data in the form of the time of each User’s activity in connection with the use of the Site, including registration, login and transaction times;
  11. Usage data or User preferences, including User interactions in using the Site, saved choices, and selected settings. This data is obtained using cookies, pixel tags, and similar technologies that create and maintain unique identifiers;

Data obtained from other sources, including but not limited to:

  1. Data from financial service providers, including but not limited to credit rating agencies or bureaus or Credit Information Management Institutions (LPIP)
  2. Data from financial service providers (if the User uses payment-specific features).
  3. Eranyacloud can combine data obtained from the sources mentioned in these provisions with other data it has.
  4. While the user is accessing and using the site, there will be cookies on the user’s device, namely automatic files that are placed on the user’s device which carry out the function of storing user preferences and configurations. Cookies are not to be used to access other data that the User has on the User’s computer device, other than what the User has agreed to submit.
  5. Users can choose to modify the User’s browser settings by choosing to reject cookies, but this choice can prevent the Eranyacloud service from running optimally.
  6. Eranyacloud may use features provided by third parties to improve services, promotions, customization for each user based on interests or visit history. If the user does not like it, the user can adjust it via the browser.

3. Use of Personal Data

Personal Data is processed and analyzed in accordance with Eranyacloud’s needs, the purpose of which has been clearly stated when the data is obtained and collected based on consent.

Eranyacloud may use Personal Data obtained and collected from Users as stated in point II for the following:

  1. Process all forms of requests, activities or transactions carried out by Users through the Site.
  2. Providing features to provide, realize, maintain and improve Eranyacloud products and services, including features to provide personalized Eranyacloud User accounts (e.g. wishlist, shopping basket, cancellation) and/or assist users in communicating with Eranyacloud Customer Service and improving Customer Service .
  3. Contacting Users via email, letter, telephone, fax and other forms of communication, including but not limited to assisting and/or completing the transaction process or problem resolution process, as well as providing news or other notifications regarding the protection of User Personal Data by Eranyacloud, including failures protection of User Personal Data;
  4. Use data/or information obtained from Users for the purposes of research, analysis, development and testing of Services to improve the security of services on the Site;
  5. Providing information to Users regarding Eranyacloud services, promotions, studies, surveys, news, latest developments, events and other information, both through the Site and through other media. Eranyacloud may also use this information to promote, provide prizes, and present relevant advertising and content about Eranyacloud services;
  6. Supervise and/or investigate suspicious transactions or transactions that are indicated as fraud or violations of the Terms and Conditions or applicable legal provisions, and take necessary actions as a follow-up to the results of monitoring and/or investigating such transactions;
  7. In certain cases, if ordered by statutory provisions, especially statutory provisions in force in the Republic of Indonesia, use or disclose User Personal Data for law enforcement purposes or to fulfill the requirements and obligations of applicable statutory regulations, including in the event of disputes or legal proceedings between Users and Eranyacloud, or suspected criminal acts such as fraud or data theft;
  8. Eranyacloud may process personal data received from Third Parties and/or from sources accessible to the Public (e.g. business partners of customers, business lists, association lists, country lists, press, media) in permitted ways (e.g. for order fulfillment/ contract, fulfillment of legal obligations or consent given by the Customer).

4. Disclosure of User Personal Data

Personal Data collected by Eranyacloud is prohibited from being sold, transferred, given or otherwise conveyed to third parties unless otherwise determined by the laws and regulations in force in Indonesia.

  1. Eranyacloud will maintain the confidentiality of User Personal Data which is under Eranyacloud’s control and guarantees no disclosure, sale, transfer, distribution and/or loan of User Personal Data to other third parties, without the consent of the User;
  2. In certain cases, Eranyacloud can disclose, transfer, distribute and/or lend Personal Data to other third parties, however, third party service providers, agents and/or affiliates or related companies and/or other third parties will only manage and/or utilize User Personal Data in connection with one or more purposes as regulated in this Privacy Policy and in accordance with the provisions of applicable laws and regulations. The conditions referred to in point 2 include:
  3. Eranyacloud provides and shares user Personal Data with its subsidiaries and affiliates in order to provide services or carry out data processing for and on behalf of Eranyacloud;
  4. Eranyacloud may provide User Personal Data to partners, consultants, vendors, or similar service providers in the context of marketing activities carried out by third parties, improving and maintaining the quality of Eranyacloud services, as well as other publication activities;
  5. Eranyacloud requires communication with Eranyacloud business partners (in this case with partners related to payments, feature providers, promotions and other facilities if any) with Users to resolve problems and other matters;
  6. Eranyacloud may provide User Personal Data to third parties who use and integrate public APIs provided by Eranyacloud or for other purposes of using Personal Data as mentioned in this Privacy Policy;
  7. In the event that the authorized agency (in accordance with the provisions of applicable laws and regulations) requests user Personal Data Information held by Eranyacloud.

5. Storage & Security of Personal Data

Storage of Personal Data by Eranyacloud is carried out in the form of encrypted data.

  1. Eranyacloud strives to maintain security and integrity for all Eranyacloud facilities where Personal Data is stored to protect Personal Data from misuse, interference and loss from unauthorized access.
  2. Eranyacloud implements the necessary steps to safeguard Personal Data received via the website, antivirus software and firewall protection, access restrictions on computer system security.

6. Deletion of Personal Data

Eranyacloud will delete the User’s personal data on Eranyacloud if:

  1. Personal Data is no longer necessary to fulfill the purposes for which it was collected;
  2. Storage of personal data is no longer required for the purposes of compliance with applicable laws and regulations, especially laws and regulations in force in the Republic of Indonesia.
  3. At the request and approval of the Personal Data Owner unless otherwise determined by the provisions of the applicable laws and regulations in Indonesia.
  4. Destruction means removing part or all of documents related to Personal Data, including electronic and non-electronic ones managed by Eranyacloud so that the Personal Data in question cannot be displayed again unless the User provides new Personal Data.
  5. Users expressly understand that it is still possible for some User Personal Data to be stored by other parties, including authorized state administration bodies. In the event that Eranyacloud shares User Personal Data with the agency in question or other bodies that may be appointed by the authorized government or have collaboration with Eranyacloud, the User agrees and agrees that the storage of User Personal Data by that agency will follow the data storage policy of each agency. .

7. Access, Correction, Recall, Consent to User Personal Data

  1. Eranyacloud will verify the User’s personal data received by Eranyacloud. Users must agree to provide data that is true and accurate and free from false or misleading information, including notifying Eranyacloud as soon as possible of any changes to the User’s Personal Data and/or if there are errors in the User’s personal data that hinder Eranyacloud. Eranyacloud can refuse, cancel or if necessary request additional information from the User.
  2. Customers may request access to the relevant Personal Data with the aim of verifying that the data is accurate, complete and up to date. Customers request access by submitting a written request to Eranyacloud accompanied by sufficient proof of identity to Eranyacloud.
  3. Eranyacloud may charge Users an administration fee for handling requests for use of user access rights.
  4. Eranyacloud has the right to refuse requests for access or correction of personal data if according to Eranyacloud the request from the Customer is repeated without reason, requires inappropriate technical efforts, endangers other people’s Personal Data and/or other reasons.
  5. The customer gives consent to Eranyacloud to display the Customer Personal Data Protection guarantee statement on the site page.
  6. Unless it is in conflict with applicable statutory provisions, Users can withdraw their consent to the acquisition, collection, storage, management and use of User Personal Data by submitting a written request to Eranyacloud. Eranyacloud will process the request and subsequently Eranyacloud will no longer process the user’s Personal Data.
  7. By withdrawing this agreement, the User is deemed to have understood the consequences of the User not being able to use the Service and Eranyacloud may no longer be able to carry out obligations related to the service so that any legal relationship between Eranyacloud and the User will end and cannot be continued.

8. Personal Data Complaints

  1. If Users have complaints regarding Personal Data, Customers can submit via email to : support@eranyacloud.com.
  2. The complaint submitted must include the identity and nature of the User’s complaint regarding the service in question.
  3. Furthermore, Eranyacloud will follow up on the complaint and provide a response to the complaint.

9. Privacy Policy Updates

  1. Eranyacloud reserves the right to make changes or updates to this Privacy Policy at any time.
  2. Users hereby agree to read and update this Privacy Policy page from time to time to be aware of changes. As long as Customers access and use Eranyacloud services, Customers are deemed to agree to changes in the Privacy policy.

Data Security Policy

1. General

Product and Service Data Security Policy is a commitment of PT. Era Cloud Digital (“EranyaCloud”) to protect any personal data or information of Customers who use all PT Services. Era Cloud Digital also includes services available on the EranyaCloud website) with the official web address https://eranyacloud.com  along with affiliate PT. Era Awan Digital, its derivative sites (eranyacloud.id, eranyacloud.co.id etc.), including but not limited to Services owned by PT. Digital Cloud Era Available on the PT device application. 2. Data Ownership

As between the parties, Customer retains all right, title and interest in and to Customer’s data. EranyaCloud has no rights to Customer data other than the rights granted by Customer to EranyaCloud. EranyaCloud will use and otherwise process Customer Data, only to:

  1. Provide Products and Services to Customers in accordance with the information documented in the product or Service details.
  2. Business operational needs in handling requests or handling incidents in providing Products and Services to Customers.
  3. Improvement of Products and Services to Customers.

3. Disclosure of Processed Data

EranyaCloud will not disclose or provide access to any Processed Data unless:

  • as directed by the Customer; and
  • as required by law.

For the purposes of this section, “Processed Data” means:

  1. Customer data
  2. Product and Service Data
  3. Personal data
  4. Any other data processed by EranyaCloud in connection with the Products and Services used by Customers.

EranyaCloud will not disclose or provide access to any Processed Data to anyone unless required to do so by law. If law enforcement contacts EranyaCloud with a request for Processed Data, EranyaCloud will attempt to direct the law enforcement agency to request such data directly from Customer. If compelled to disclose or provide access to any Processed Data to law enforcement, EranyaCloud will immediately notify Customer and provide a copy of such request unless legally prohibited from doing so.

Upon receipt of any other third party request for Processed Data, EranyaCloud will promptly notify Customer unless prohibited by law. EranyaCloud will deny such requests unless required by law to comply. If the request is valid, EranyaCloud will try to direct the third party to request data directly from the Customer.

EranyaCloud will not provide to any third party:

  1. Direct, indirect, comprehensive or unlimited access to Processed Data;
  2. Platform encryption keys used to secure Processed Data or the ability to break such encryption; or
  3. Access to Processed Data if Microsoft knows that the data will be used for purposes other than those stated in the third party request.

To support the above, Microsoft may provide Customer’s basic contact information to third parties.

5. Data encryption

Data transfers via public networks between customers and services at the EranyaCloud data center are encrypted by default.
However, it is possible that Customers can install third-party applications that allow Customers to transfer data without encryption to Customer VMs in the EranyaCloud datacenter. For this reason, the Customer is responsible for the security of data transfer.
EranyaCloud also provides encryption“at rest” for customer data in the EranyaCloud datacenter.

6. Access to Data

EranyaCloud uses a minimum possible access rights control mechanism to Customer data. Role-based access rights controls are used to ensure that access to Customer data required for service operations is for appropriate purposes and approved by Customer with management oversight.

7. Customer Responsibilities

Customer is solely responsible for making independent decisions regarding whether technical and organizational measures for Products and Services meet Customer’s requirements.
Customer acknowledges and agrees that (taking into account current circumstances, implementation costs, and the nature, scope, context and purpose of the processing of its Data as well as the risks to individuals) the security practices and policies implemented and maintained by EranyaCloud provide a level of security appropriate to the risks with respect to its Data .
Customer is responsible for implementing and maintaining privacy protection and security measures for supplied or controlled components.

8. Audit Compliance

EranyaCloud will conduct a security audit of the systems and data centers it uses in processing Customer Data, as follows:

  1. If standards or frameworks require such audits and they are conducted at least once a year.
  2. Each audit will be conducted in accordance with the standards and rules of the regulatory or accrediting body for each applicable standard or control framework.
  3. Any audit will be conducted by a qualified and independent third party security auditor at EranyaCloud’s option and expense.

Each audit report will be provided by EranyaCloud at (link) or another location identified by EranyaCloud.
This Audit Report will be EranyaCloud’s Confidential Information because it clearly discloses any material findings by the auditor.
EranyaCloud will immediately correct the findings raised in the Audit Report. If necessary, EranyaCloud will provide each Audit Report to the Customer but is subject to the confidentiality and distribution restrictions of EranyaCloud and the auditor.
If Customer requires EranyaCloud to perform additional activities related to audit needs, then prior to the start of the audit, Customer and EranyaCloud will jointly agree on the scope, time, duration, control and evidence requirements, as well as costs for the audit, provided that the terms for agreeing on the activities This will not unreasonably delay EranyaCloud’s audit performance and EranyaCloud has the full right to refuse to carry out such additional activities without any consequences.

9. Security Incident Notification

If EranyaCloud becomes aware of a security breach that results in the unintentional or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Customer Data while it is being processed by EranyaCloud (each, a “Security Incident”), EranyaCloud will immediately and without undue delay (1) in notifying Customer of a Security Incident; (2) investigate Security Incidents and provide Customer with detailed information about Security Incidents; (3) take necessary steps to reduce the effects and minimize damage resulting from a Security Incident.
Security Incident Notifications will be sent to Customer by any means Customer chooses, including via email. Customer is solely responsible for ensuring Customer maintains accurate contact information with EranyaCloud for each applicable Product and Service. Customer is solely responsible for complying with its obligations under incident notification laws applicable to Customer and fulfilling any third party notification obligations related to any Security Incident.
EranyaCloud’s notification or response to a Security Incident under this section is not an admission by EranyaCloud of any fault or liability in connection with a Security Incident. Customer shall immediately notify EranyaCloud of any possible misuse of its account or authentication credentials or any security incident related to the Products and Services.

10. Data & Location Transfer

Customer data that EranyaCloud processes on behalf of the Customer may not be transferred to, or stored and processed in another geographic location except with the Customer’s consent.
EranyaCloud will store Customer Data at rest within certain key geographic areas as specified in the Product or Service details.
EranyaCloud does not control or limit the areas in which Customer or Customer’s end users can access or transfer Customer Data.

11. Data Retention & Deletion

During the applicable subscription term, Customer will have the ability to access, extract, and delete Customer Data stored in each Service.
Customer data that is no longer needed and has passed the storage period according to the applicable provisions (for a trial account period of 2 weeks) will be destroyed by deleting some or all of the files, including those in electronic and non-electronic form.
Basically, Customer data will be deleted after the contract is completed, and this deletion is subject to Customer approval or objection.
If required by law, EranyaCloud will store Customer data in accordance with applicable legal requirements.

12. Complaints Regarding Customer Data

  • If Customers have complaints regarding the handling of Customer Data, Customers can submit them via email to: support@eranyacloud.com.
